Magna Carta for Seafarers Signed to Protect Filipino Seafarers’ Rights

On Monday, September 23, President Ferdinand Marcos Jr. signed the Magna Carta for Seafarers, aimed at safeguarding the rights and welfare of Filipino seafarers. Marcos highlighted that the law reflects the government’s appreciation for the sacrifices made by seafarers, whose contributions are crucial to the country’s economy and maritime sector. “It is our way of saying to our seafarers, we see you, we hear you, and we support you,” he stated. He also emphasized the importance of protecting seafarers not only from maritime dangers but also from exploitation and discrimination. Marcos had initially vetoed the bill in February 2024 for further review.
Section 59 of the Magna Carta for Seafarers requires Filipino seafarers to provide a financial guarantee or bond before a legal ruling in their favor can be enforced. This provision was the reason President Marcos sent the charter back to Congress for review. Senators Risa Hontiveros and Koko Pimentel opposed the provision, calling it unfair to seafarers. Pimentel argued that it would delay the execution of favorable rulings for seafarers until all appeals by foreign employers were exhausted, describing it as discriminatory. Supporters of the provision believe it would enhance the employability of Filipino seafarers, while international maritime groups urged Marcos to retain it, claiming it would prevent “ambulance chasing.”
In May 2024, a maritime group expressed concern that many seafarers deserving lawful disability benefits were not receiving them because a significant portion was being taken by “ambulance chasers.” These are lawyers who reportedly persuade injured seafarers or workers to pursue monetary claims against their employers. Responding to the growing issue of ambulance chasing, President Marcos established the International Advisory Committee on Global Maritime Affairs in January 2023. This committee was created to provide expert advice on key maritime concerns that affect Filipino seafarers, ensuring their rights and interests are protected while addressing challenges within the industry.
